Refer a Friend Terms & Conditions

By participating in our Refer a Friend programme you are confirming that you accept the following terms and conditions:

1. REFERRALS

1.1 Subject to your compliance with the terms and conditions, TorFX will pay you AU$100 account credit for each new private client you refer that transfers over $2,000 (or equivalent) with us.

1.2 The transfer must involve the conversion of one currency for another, e.g. Australian Dollars for Pounds. Same currency transfers (Australian Dollar to Australian Dollar) are not eligible for this promotion.

1.3 The referred client must transfer a minimum of $2,000 (or equivalent) for both parties to qualify for the account credit. Credit will be issued within 30 days of the referred client trading with us.

1.4 While there is no limit to the number of referrals you can make, if we feel the people being referred do not have a genuine requirement for our services, we reserve the right to cap the number of account credit issued.

1.5 All account credit will be issued in AUD.

1.6 This offer replaces the previous Refer a Friend offer promoted by TorFX until 30/11/2024. Any referrals made prior to 30/11/2024 will be subject to the terms and conditions of that offer, available here.

2. ELIGIBILITY

2.1 Employees, immediate family members (including spouse, children, parents, siblings, grandparents) of employees of TorFX, and referring partners (current affiliates and their employees) cannot participate in the Refer a Friend programme.

2.2 You must be registered with TorFX to participate in the Refer a Friend programme.

2.3 You cannot reside at the same address as the client you refer.

2.4 This offer is not available in conjunction with any other offer.

2.5 This offer is not available in respect of any referred client who has had an account with TorFX within the previous 12 calendar months.

3. PROHIBITED USES

You may only participate in the Refer a Friend programme in good faith for lawful purposes. You may not:

• (a) create more than one account in order to invite yourself.
• (b) refer an entity in which you have a beneficial or legal interest or control.
• (c) invite people that you do not know personally.
• (d) transmit any unsolicited or unauthorised advertising or promotional material.
• (e) do anything that damages TorFX’s brand or reputation.
• (f) attempt to circumvent the terms and conditions.
• (g) have any involvement with the referred client’s account after the initial referral.
• (h) arrange the provision of any financial service or product, nor commit TorFX in any way, nor act in any manner in which you may be construed as an agent or representative of TorFX.

4. DATA PROTECTION

You must confirm that you have obtained consent from the individuals whose data you provide us with.

5. BREACH OF TERMS AND CONDITIONS

5.1. TorFX has the right to refuse to pay you the referral fee if we suspect that you have not used the Refer a Friend programme in good faith or have breached the terms and conditions.

5.2. TorFX will determine, at its sole discretion, whether there has been a breach of the terms and conditions. When a breach has occurred, TorFX reserves the right to terminate or suspend the Refer a Friend programme at any time.

5.3. A failure by TorFX to exercise any of its rights does not constitute a waiver of such rights.

6. LIMITATION OF LIABILITY

Except for any liability that cannot by law be excluded, TorFX shall not be liable for any injury, loss or damage, howsoever caused, whether direct, indirect, special or consequential, arising in any way out this programme.

7. VARIATION

7.1 TorFX reserves the right, at its sole discretion, to change the terms and conditions without prior notice. Continued use of the Refer a Friend programme shall amount to acceptance of the terms and conditions in force at that time.

7.2 TorFX reserves the right, at its sole discretion, to change, suspend or terminate the Refer a Friend programme at any time, without notice.

8. APPLICABLE LAW

These terms and conditions and any relationship between you and TorFX Pty Ltd shall be governed by Queensland law and subject to the exclusive jurisdiction of the Queensland courts.
